Terms of Service

These Terms are a working legal draft for Scenery's subscription service on the web, iOS, and Android, and should be reviewed by qualified counsel before production launch.

These Terms describe the rules for using Scenery, an audio service for discovering, streaming, and managing immersive audio experiences.

1. Agreement to These Terms

By accessing or using Scenery, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

When these Terms use “Scenery,” “we,” “us,” or “our,” they refer to the operator of the Scenery service.

2. Eligibility and Accounts

You must be able to form a binding contract to use Scenery. If you use Scenery on behalf of an organization, you represent that you have authority to accept these Terms for that organization.

You are responsible for the accuracy of your account information and for keeping your sign-in credentials secure. Tell us promptly if you believe your account has been accessed without permission.

3. The Service

Scenery is available on the web, iOS, and Android. It provides audio streaming in binaural and Atmos formats, discovery and recommendations, a personal library of likes, playlists, and downloads, a profile, notifications, share links, and issue reporting. A daily listening quota applies, and some features require a paid subscription or are available only on certain platforms, regions, browsers, or devices.

Adding audio to the Scenery catalogue is restricted to administrators. The upload, media-processing, and metadata-translation tools are not part of the service offered to listeners.

We may change, suspend, or discontinue parts of the service when needed to maintain, improve, secure, or operate Scenery. We will try to provide reasonable notice when a change materially affects paid access.

4. Subscriptions and Billing

On iOS and Android, paid subscriptions are sold through the Apple App Store or Google Play under those stores’ terms, and RevenueCat manages the resulting entitlement. On the web, paid subscriptions are sold through RevenueCat Web Billing, whose payment processor is Stripe. Starting a web purchase sends you to a checkout page hosted by RevenueCat and Stripe, and you enter your card details there rather than in Scenery. Prices, plan features, trial availability, billing intervals, taxes, and renewal terms are shown during checkout before purchase.

Renewals
Subscriptions automatically renew at the end of each billing period unless canceled before renewal. By starting a subscription, you authorize recurring charges for the selected plan, including applicable taxes and fees.

Cancellations
Cancel a store subscription in your Apple or Google account. Cancel a web subscription through the account, billing, or customer portal made available by Scenery or RevenueCat. Cancellation stops future renewals but does not automatically refund past charges. Paid access generally continues until the end of the current billing period. Deleting your Scenery account does not cancel any of these subscriptions.

Failed Payments
The billing provider may retry a failed charge, request a payment-method update, or place the subscription in a grace, paused, or expired state. Scenery may limit paid features until billing is restored.

Refunds
Refunds for Apple App Store and Google Play purchases are handled by Apple and Google under their own policies. For other purchases, refund requests are reviewed case by case unless applicable law requires otherwise. Contact support with the account email, purchase date, and reason. Payment processors may require additional verification.

5. Your Content

Adding audio to the Scenery catalogue is restricted to administrators, so as a listener you cannot upload tracks. What you contribute is your display name, your profile photo, the titles and order of your playlists, the description, error trace, and screenshots you submit in an issue report, and the share links you create.

You keep ownership of what you contribute. You grant Scenery a limited, worldwide, non-exclusive license to host, store, process, reproduce, display, and distribute it as needed to provide and operate the service. This license ends when the content is deleted, except where retention is reasonably needed for backups, safety, legal compliance, dispute resolution, or legitimate business records.

A share link is a bearer capability. Anyone holding the link can see the shared track’s title, artist, description, artwork, duration, and tags, and can play its binaural audio without a Scenery account; the Atmos version is never shared. Every successful authorization extends the link by another 24 hours until you revoke it — that is the moment a holder asks us for the audio, whether or not they go on to listen to any of it — and sending the link to a social service gives that service the link too. Share links only with people you intend to give access.

You are responsible for having the rights needed for what you contribute. Do not submit content that infringes rights, violates privacy or publicity rights, contains malware, or is unlawful, abusive, deceptive, or harmful.

6. Acceptable Use

You agree not to misuse Scenery, including bypassing access controls, scraping or copying at scale, interfering with security or operations, distributing illegal content, impersonating others, or violating applicable law.

We may remove content or restrict accounts when we reasonably believe there is a Terms violation, legal requirement, rights-holder complaint, or risk to users, the service, or third parties.

7. Intellectual Property

Scenery, including its software, branding, visual design, features, and service content, is owned by Scenery or its licensors and protected by law. These Terms do not transfer ownership of Scenery or third-party content to you.

Subject to these Terms, we grant you a limited, personal, non-transferable, non-exclusive right to access and use Scenery for its intended purpose.

8. Third-Party Services

Scenery relies on Supabase for authentication and application data; Cloudflare for hosting, security, network services, and media storage and processing; RevenueCat together with the Apple App Store and Google Play for subscriptions; Google and Apple for optional sign-in; Firebase Cloud Messaging for push notifications; Resend for email; and a configured machine-translation provider for catalogue metadata.

Third-party services may have their own terms and privacy notices. We are not responsible for services we do not control, but we choose providers to support Scenery’s operation and security.

9. Disclaimers

Scenery is provided on an “as is” and “as available” basis. We aim for reliability but do not promise uninterrupted, error-free availability on every device or browser.

To the extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the extent permitted by law, Scenery and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or business interruption arising from use of the service.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Termination

You may stop using Scenery at any time. We may suspend or terminate access if you violate these Terms, create risk, or if law requires it.

Provisions that by their nature should survive will continue, including payment obligations, intellectual property, disclaimers, limitations of liability, and dispute-related provisions.

12. Changes to These Terms

We may update these Terms. If changes materially affect your rights or paid subscription, we will provide reasonable notice, such as in-app notice, email, or an updated effective date. Continued use after changes take effect means you accept them.

13. Governing Law and Contact

Except where prohibited by applicable law, these Terms are governed by laws applicable to the operator’s principal place of business, without regard to conflict-of-law rules.
